Understanding Municipal Right of Way and Tree Maintenance Responsibilities
There’s a common misunderstanding that the Borough is responsible for maintaining trees from the road’s centerline to private property boundaries. This is not true. Every property along Borough and County roads includes a right of way, which allows the Borough limited use of that area for public projects — such as widening roads or installing drainage — but it does not transfer maintenance responsibilities.
Property owners are responsible for trimming, removing, or maintaining trees on their property, including those that may pose hazards to others. The Borough DPW can only remove trees or limbs that have fallen onto the roadway, and not those affecting power lines.
